By placing your Order or submitting a Gratitude Giveaway request, you acknowledge and agree that:

1. The artwork you have ordered or requested is protected by United States Copyright Law. I own and reserve all copyrights and other rights to the artwork, including the right to display the artwork in advertising materials as examples of my work. You agree that, to the extent you submit ideas, suggestions or contributions in connection with any artwork that you order or request from me that become part of the final artwork delivered to you, the rights to such ideas and contributions are and shall be the property of Mara Zepeda/Neither Snow.

2. Subject to my acceptance of your Order or my selection of you as a recipient of a Gratitude Giveaway, as the case may be, I grant you a one-time, personal, non-transferrable, non-exclusive license to use the artwork. With respect to tattoos of one file, my license is limited to one-time use by one person. You may not sell, alter, or publish the artwork. You must obtain prior written permission from me for any use of the artwork other than that originally intended.

3. Selection of recipients of the Gratitude Giveaway is entirely within my discretion. The Gratitude Giveaway is void where prohibited by law and is subject to all applicable laws and regulations. Taxes are solely the responsibility of the recipient.

4. By submitting a Gratitude Giveaway request, you grant to me, and my licensees and assigns, permission to use your name and the request itself and related materials submitted by you in connection with the Gratitude Giveaway and Neither Snow, including for promotional purposes. You further agree, if you are selected as the recipient of a Gratitude Giveaway, to submit an original photograph of the applied tattoo, and you grant me permission to publish the photograph and your Gratitude Giveaway submission or portions or summaries of it in connection with the Gratitude Giveaway. You warrant that you own or are authorized to grant such rights to the photograph and other submitted materials and that my use of them under these Legal Terms will not infringe the rights of others.

5. Under no circumstances will I or my successors, agents or assigns be held liable for damages, including incidental, special or consequential damages, expenses, costs or other liabilities, arising out of or related to the artwork or the Gratitude Giveaway. You agree to release, indemnify and hold me, and my successors, agents, and assigns, harmless from and against any loss, liability or damage arising from your use of the artwork, your participation in the Gratitude Giveaway or your breach of these Legal Terms.

6. These Legal Terms apply regardless of the amount and nature of the compensation paid by you to me, if any, in exchange for the artwork.
